General Terms and Conditions (GTC)
of EvyTradingGroup
1. Scope of Application
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") govern the contractual relationship between EvyTradingGroup (hereinafter referred to as "the Company") and its clients (hereinafter referred to as "the Client"). The GTC apply to all services and products offered by the Company, including but not limited to the Mentoring Program, Portfolio Management Services, Online Educational Programs, the EvyEdgeTerminal, and VIP Trading Signal Access.
1.2 These GTC apply to all contracts concluded through the Company’s website, online consultations, and other electronic or digital means, including email, WhatsApp, and video conferencing platforms (e.g., Zoom).
1.3 By entering into a contract with the Company or using its services, the Client acknowledges and agrees to be legally bound by these GTC.
1.4 The Company reserves the right to amend or supplement these GTC at any time. Any changes will be communicated to the Client in written form (email or notification via the platform) at least 30 days prior to their effective date. Continued use of the services following such notification constitutes acceptance of the revised GTC.
1.5 Deviating or conflicting terms and conditions of the Client shall not apply unless explicitly confirmed in writing by the Company.
1.6 These GTC apply equally to private individuals and business customers, regardless of their geographic location.
2. Conclusion of Contract
2.1 A legally binding contract between the Company and the Client is established upon completion of the following steps:
The Client selects a service or product via the Company’s website or during a personal consultation.
The Client explicitly accepts the terms and conditions of the service during the checkout process or in writing.
The Company receives payment confirmation or a signed contract from the Client.
2.2 For specific services, such as the Mentoring Program, a signed contract is required before services commence.
2.3 The Company reserves the right to decline service requests or terminate contracts if the Client provides false or misleading information, fails to meet the eligibility requirements, or violates any provisions of these GTC.
2.4 All contracts are stored electronically, and the Client will receive a digital copy via email for their records.
3. Description of Services
3.1 EvyCapitalManagement (ECM):
ECM provides professional asset and portfolio management services.
Client funds are managed within the EvyCapitalFund (ECF) and EvySavingsBank (ESB) portfolios.
ECM does not guarantee returns but ensures transparency through performance reports.
3.2 EvySavingsBank (ESB):
Offers long-term investment portfolios with an estimated annual yield of around 10% (subject to market conditions).
Clients authorize ECM to trade and invest with their deposited funds.
A portfolio management fee of €29.99 per month applies.
3.3 EvyTradingSchool (ETS):
Provides educational services in financial trading and risk management.
Beginner Course: €29.99/month or €6.49/week.
Intermediate Course: €49.99/month or €9.99/week.
VIP Trading Signals: €24.99/month or €5.55/week.
Mentoring Program (MSP): €5,000 one-time payment or installment plans with progressive interest rates.
3.4 EvyEdgeTerminal:
A premium trading data platform providing real-time market analysis tools and economic indicators.
4. Payment and Fulfillment Policy
4.1 Accepted Payment Methods:
Payments can be made via PayPal and Stripe.
4.2 Billing and Fees:
Subscription-based services renew monthly or weekly, depending on the chosen plan.
A fixed processing fee of €15 is charged for each deposit into a portfolio.
4.3 Service Activation:
Services typically commence after full payment is received. For the Mentoring Program, services may begin immediately upon contract signing.
4.4 Installment Payment Options for the Mentoring Program:
24 Months: 5.0% p.a., €219.79/month, Total: €5,275.
36 Months: 6.0% p.a., €152.76/month, Total: €5,499.
48 Months: 7.5% p.a., €117.11/month, Total: €5,621.
60 Months: 9.0% p.a., €100.60/month, Total: €6,036.
72 Months: 11.0% p.a., €89.17/month, Total: €6,421.
100 Months: 13.5% p.a., €70.64/month, Total: €7,064.
4.5 Late payments may result in service suspension and incur additional fees.
5. Right of Withdrawal
5.1 Withdrawal Period:
Clients may withdraw from the contract within 14 days of signing without providing a reason.
5.2 Exemptions from Withdrawal:
No withdrawal is permitted if services have been fully rendered or commenced with the Client’s consent.
5.3 Consequences of Withdrawal:
Clients are responsible for paying for services rendered up to the withdrawal date.
5.4 Special Clause for Installment Payments:
Clients using installment payment plans are still obligated to fulfill their payment obligations even after withdrawing if services have begun.
6. Liability and Indemnification
6.1 The Company is not liable for financial losses due to market fluctuations, economic downturns, or client decisions.
6.2 Clients acknowledge the inherent risks associated with trading and investing.
6.3 The Company’s liability is strictly limited to the fees paid by the Client for the services.
7. Confidentiality and Intellectual Property
7.1 All educational materials, tools, and data provided by the Company remain its intellectual property.
7.2 Clients are prohibited from copying, distributing, or using Company materials without written consent.
8. Data Protection and Privacy
8.1 The Company collects, processes, and stores personal data solely for service delivery.
8.2 Client data is protected through industry-standard security measures.
9. Dispute Resolution
9.1 Disputes should first be resolved amicably between the parties.
9.2 Unresolved disputes will be referred to arbitration in accordance with German law.
10. Final Provisions
10.1 These GTC constitute the entire agreement between the Company and the Client.
10.2 If any provision is invalid, the remaining provisions shall remain effective.
10.3 The Company’s failure to enforce any provision does not waive its right to enforce it in the future.
