ETS Passing Funded Challenge Service Agreement
This Digital Service Agreement ("Agreement") is entered into by and between EvyTradingGroup LLC ("Company") and the purchaser ("Customer") of the ETS Passing Funded Challenge Service ("Service"). By purchasing the Service, the Customer agrees to the terms and conditions set forth herein.
1. Service Description
The Company offers the Service to manage and execute the Customer's ETS Funded Challenge on their behalf. The objective is to successfully complete both Phase 1 and Phase 2 of the challenge.
2. Service Fee
The fee for the Service is 2.5 times the original price of the ETS Funded Challenge, excluding applicable taxes.
3. Success Criteria
Success is defined as the successful completion of both Phase 1 and Phase 2 of the ETS Funded Challenge.
4. Refund Policy
Unsuccessful Completion: If the Company fails to achieve success as defined in Section 3, the Customer will be entitled to a refund of 80% of the Service fee paid.
Force Majeure: No refund will be provided if the failure to complete the challenge is due to events beyond the Company's control, as determined solely by the Company.
5. Customer Conduct
Account Access: The Customer agrees not to open or execute any trades on the account while the Service is active.
Violation Consequences: Upon the first violation, the Customer will receive a warning. A second violation will result in a final warning. A third violation will lead to immediate termination of the Service without any refund.
6. Limitation of Liability
The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service. The Company's total liability shall not exceed the amount paid by the Customer for the Service.
7. Indemnification
The Customer agrees to indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from the Customer's breach of this Agreement.
8. Amendments
The Company reserves the right to modify these terms at any time. Continued use of the Service after such modifications constitutes acceptance of the new terms.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is established.
10. Entire Agreement
This Agreement constitutes the entire understanding between the parties concerning its subject matter and supersedes all prior discussions and agreements, whether oral or written.
By purchasing the Service, the Customer acknowledges that they have read, understood, and agreed to these terms and conditions.
